RESUMO:

Water is essential for the development of human activities. In the last decades, there has been a significant increase in the demand for water, which is due to economic processes, population growth, among other factors. Water, an essential element of life, will be considered a strategic element in business in this century. Some companies are convinced that, in the near future, whoever controls the planet's water will dictate the rules of the product. Currently, water has been traded as a commodity in the futures market and even has an index: the Nasdaq Veles California Water (NQH2O). The water being traded on the US stock exchange is not to be stored in warehouses. What is really being quoted are the rights to use water. In Brazil, this right of use is conferred by the issuance of the so-called water use right grant, which was instituted by Law No. 9.433 / 1997 (National Water Resources Policy - PNRH), as one of its water resources management instruments. This legal instrument has the characteristic of being a “command and control” tool, and aims to ensure the use of water, with quantitative and qualitative criteria, in order to guarantee the effective exercise of the right of access to water resources by the user, in addition to seeking to protect water resources, through criteria and conditions that must be respected, above all, the environment. Although the grant has several positive points, in Mato Grosso, it needs improvement and, currently, it runs the risk of having its application finalized with the issuance of the granting act, which would invalidate its purpose, considering that it is not summarizes the simple issuance of the granting act. That said, this work, in addition to analyzing the granting system carried out in the State of Mato Grosso, wants to point out solutions aimed at promoting greater efficiency to the granting instrument. The development of this work took place through a survey carried out based on information obtained from the water resources management agency (SEMA / MT) in its database and other sources of information, plus extensive bibliographic and documentary research related to management water resources not only in the State of Mato Grosso but also in places that serve as a reference in the management of water resources, with a focus on the granting of water resources. After this survey, the results obtained pointed out that there are certain deficiencies that, if overcome, may make the instrument for granting water resources more effective for achieving the purposes for which it is intended
