THE ARTICLE 484-A OF THE 2017 LABOR REFORM INVESTIGATED THROUGH MICHEL FOUCAULT'S DISCOURSE ANALYSIS

The central objective of this study is to reflect upon the text presented in Article 484-A of Law 13.467, considering it as part of the statements within Labor Law, and to comprehend the discursive formation in which the 2017 Labor Reform is situated. In this manner, the subject is approached from a Foucauldian Discourse Analysis perspective, adopting the concepts of discourse, statement, discursive formation, and power as references for the proposed analysis. The study has a theoretical-reflective character as it employs concepts defined by Michel Foucault to investigate the text of the Law. Within the broader context of Law, the study situates the transformations within Labor Law while contemplating its foundational discourses. Starting from the notion of legislation that favors workers, an initial observation of Article 484-A places it against the current by reducing labor guarantees. However, the adoption of the concepts of statement and power brings forth issues related to ruptures within Labor Law, which, from the perspective of relations among subjects, may reveal changes in the discourse of the State.
