Affiliated to the assumptions of Discourse Analysis (AD) founded by Michel Pêcheux (2015, 1997, 1999, [1969] 1997, [1983] 1993, [1975] 1997, 1990) and spread throughout Brazil by several scholars, enrolled in the area called Study of Linguistic Processes, of the Stricto Sensu Postgraduate Program in Linguistics (PPGL) of the Mato Grosso State University (UNEMAT), this research has been orientated in the line of Discourse Processes Studies to develop the theme of tensions in/of legal discourse among subjects who Has been occupated favorable and contrary positions to the "decriminalization of homotransphobia". In this scenario, we aimed to analyze the operation of the legal discourse, based on the oral arguments presented by the subject-lawyers who presided over the trial of the Writ of Injunction (MI 4733) and Direct action of Unconstitutionality for Omission (ADO 26), both dealt with in the Supreme Court (STF) in 2019. In this paper the theoretical-analytical device is composed of the notions of Discursive Formations (FD's), subject-position, discursive memories, and imaginary formations (IF). Added to the concepts, we address sexual representations in two major social formations, being: I) hegemonic (cisheteronormative) identity and II) dissident identities (homo/trans/singular), on the understanding that these identities traverse and constitute the analyzed legal discourse. The research corpus was delimited from videos of the trial, specifically from four oral arguments presented to the STF, the namely, thesis of the lawyer who proposed MI 4733 / ADO 26, and three amicus curiae oral arguments, composed of two lawyers representing the Mixed Parliamentary Front for Family and Life Support (FPMFAV), and one representing the National Association of Evangelical Jurists (Anajure); these last three lawyers were against the action. After our analyses, we understand which discourse was sustained from the positions of the subject-lawyers in their relations with the discourse-others (religious, fundamental rights, cisheteronormative, and homotransphobic). The subject-positions are crossed by the sociohistorical tension between identities, they are present in the language and unmarking places, consequently, they function in the discourse production and sense effects.
