RESUMO:

The change in the paradigm of human thought with the evolution of the sciences of thought, such as philosophy and sociology, as well as the theory of law, has brought about changes in the way society relates to the State, to law and to society itself. Based on this perspective, Foucault (1979) theorized about power relations, established in the relationships of dependence and hierarchy between people and between people and institutions. On the other hand, for Hobbes, the state of permanent dispute between individuals, creating a sense effect of a real state of chaos, needs control, thus resulting in the state (as a government) in which power relations between the state entity and individuals are established. In terms of linguistics, Pêcheux (1997) postulates that the ideology that runs through discourse as well as the conditions for the production of discourse should play a leading role in the analysis of discourse, with the subject not being the subject per se, but being constituted and crossed by ideology. Faced with this postulation, we come to understand that the ideology of power that forms the existing legal discourse in Brazil is part of a larger and denser concept, which lends itself to the maintenance of the status quo of constituted power, acting preventively in the ideological identification of the subject receiving the discourse. Based on these considerations, we seek to base the present work, seeking to analyze this discourse of power, through the Analysis of the French Line Discourse, present in the judicial decisions emanating from a subject position that, by legal definition, could not distinguish the subject to whom the legal discourse is addressed by training in Law or not.
