RESUMO:

The dissertation entitled “Repercussions of ADI 282-1/2019 for the democratic management of municipal public schools in Mato Grosso”, aims to analyze the impacts of ADI 282-1/19 on democratic school management in municipalities in Mato Grosso between 2014 and 2022. The research presents contents and results of ADIs that questioned the constitutional provisions on democratic management and election for school director in the STF. Theoretical references based on: Avritzer (2020); Bobbio (2000); Bonavides (2007); Canotilho (2003); Coast (2019); Costa and Domitian (2020); Chauí (2022); Dalari (1998); Dardort et al (2021); Domitiano, Cossetin and Drabach (2021); Freitas (2018); Gohn (2012); Harvey (2008); Luck (2013); Mendonça (2000); Mosque (2005); Monedero (2019); Moraes (2014; 2019); Moreira (2002); Nicholas (2020); Paulo and Alexandrino (2012); Santos (2016); Schwarcz (2019); Schwarcz and Starling (2015); Souza (2021); Souza and Pires (2018); Streck (2001, 2011); Streck and Moraes (2014 and 2019) supported the analyses. With a qualitative approach, the research was based on bibliographic and documentary analysis of the legal bases that support democratic management and the election of school directors in the 141 municipalities in the state of Mato Grosso. It is observed that through the judgment of the ADIs, the STF changes educational policies, and the lack of clarity regarding the attributions and competences of each governmental sphere can lead to misunderstandings and setbacks in the principle of democratic management.
